Effective Date 1 April 2021.
1.1 We provide a range of services including carpet rug and upholstery cleaning and repairs and associated activities (“Services”).
1.2 If you wish us to carry out services this may come about from an enquiry and we may quote or estimate for the work. We are not obliged to carry out any Services until you accept a quote or estimate and our specific terms and conditions of performing them.
1.3 You must make available to us free access to premises required to complete Services and you agree that in doing so we may use your electricity and if necessary water to complete the work, without charge to us.
1.4 If consent is required for us to access premises and to complete Services (such as landlord or Body Corp) you must arrange that before we start work and we are not liable to you if consent is not obtained. You must notify us of any conditions of consent or other restrictions on carrying out the Services.
1.5 If due to unforeseen or unkown (by us) circumstances there is any extra cost to complete the Services you must pay this extra cost to us in addition to a quote or estimate for the work.
1.6 If you contract in the name of a company you are also personally liable to ensure compliance with these Terms and Conditions, including payment.
2.1 Payment for Services must be made in the manner agreed, which if not otherwise agreed will be 50% on acceptance of the quote or estimate and the balance on completion (plus GST in each case).
2.2 If any payment is not made when it is due you must also pay us interest on the unpaid amount from due date until payment, at the rate of 10% pa calculated daily.
2.3 You agree to reimburse us for any costs (including legal and collection costs) we incur in recovering or attempting to recover an overdue payment or cost from you.
3.1 We are liable to complete Services in the manner agreed but unless specifically stated we are not liable if an outcome expected by you is not achieved.
3.2 We are not liable for third party costs, or for any indirect or consequential losses claimed
3.3 We give the warranties implied by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 however to the extent they are able to be contracted out of they do not apply.
3.4 Neither you or us will be liable for any delay or failure to perform Services if such failure or delay is due to an event or events over which that party could not reasonably have exercised control. This includes a lockdown or restriction imposed by Government or another authority.
3.5 For certain Services we may supply you with a standard waiver (for instance for upholstery), which will also apply, and you must sign the
acknowledgement in the waiver before the Services are performed.
